These Terms of Service ("Terms") govern your access to and use of tiipikids.com (the "Site") and the products and services offered by Tiipi LLC ("Tiipikids," "we," "us," or "our"). By accessing or using our Site, placing an order, or signing up for our communications, you agree to these Terms.

If you do not agree to these Terms, do not use our Site or Services.

1. ELIGIBILITY

You must be at least 18 years old, or the age of majority in your jurisdiction, to make a purchase or create an account. By using our Services, you represent that you meet this requirement and that the information you provide is accurate.

2. ACCOUNT REGISTRATION

When you create an account, you are responsible for maintaining the confidentiality of your login credentials and for all activity under your account. Notify us immediately at hello@tiipikids.com of any unauthorized use.

3. PRODUCTS AND PRICING

We make reasonable efforts to display product descriptions, images, and pricing accurately. We reserve the right to correct errors, modify pricing, and limit quantities at any time without prior notice. Prices are in U.S. dollars unless stated otherwise.

4. ORDERS AND PAYMENT

By placing an order, you make an offer to purchase the products at the listed price. We reserve the right to accept or decline any order. Payment is processed at the time of order through our payment processors. You authorize us to charge your selected payment method for the total order amount including taxes and shipping.

5. SHIPPING AND DELIVERY

Shipping times and costs are described in our Shipping Policy. Risk of loss passes to you upon delivery to the carrier.

6. RETURNS AND REFUNDS

Returns and refunds are governed by our Refund Policy, which is incorporated into these Terms by reference.

7. SMS MESSAGING PROGRAMS

By providing your phone number and opting in, you consent to receive recurring text messages from Tiipi LLC. SMS programs operated by Tiipi LLC include:

(a) Tiipikids Customer Notifications: Order confirmations, shipping updates, customer service responses, and (where you have opted in) marketing offers and promotions.

(b) Tiipi LLC Operational Notifications: Internal business notifications sent only to authorized partners and team members of Tiipi LLC who have provided express consent.

Program Details:

Message Frequency: Message frequency varies. You may receive up to 10 messages per month for customer notifications and marketing programs.

Message and Data Rates: Message and data rates may apply. Check your mobile plan for details. Tiipi LLC is not responsible for any charges from your wireless carrier.

HELP: For help, reply HELP to any message or contact us at hello@tiipikids.com.

STOP: To opt out at any time, reply STOP to any message. After replying STOP, you will receive a confirmation message and will not receive further messages from that program. You may continue to receive messages from other programs you are opted into separately.

Supported Carriers: Compatible with major U.S. wireless carriers including AT&T, T-Mobile, Verizon Wireless, Sprint, Boost, U.S. Cellular, MetroPCS, and others. Carriers are not liable for delayed or undelivered messages.

Privacy: Information collected through SMS programs is handled in accordance with our Privacy Policy.

Eligibility: You must be 18 or older to enroll in our SMS programs. By opting in, you confirm you are the account holder of the mobile number provided or have permission from the account holder to enroll.

8. INTELLECTUAL PROPERTY

All content on our Site, including text, graphics, logos, images, product designs, and software, is owned by or licensed to Tiipi LLC and is protected by copyright, trademark, and other intellectual property laws. You may not reproduce, distribute, modify, or create derivative works without our written permission.

9. USER CONTENT

If you submit reviews, comments, or other content to our Site, you grant Tiipi LLC a non-exclusive, royalty-free, perpetual, irrevocable, worldwide license to use, reproduce, modify, and display that content in connection with our Services and marketing.

10. PROHIBITED USES

You may not use our Services to: (a) violate any law or regulation; (b) infringe on the rights of others; (c) transmit viruses or malicious code; (d) attempt to gain unauthorized access to our systems; (e) interfere with the operation of our Services; (f) use automated systems such as bots or scrapers without our written permission; or (g) engage in fraudulent activity.

11. DISCLAIMERS

Our Services and products are provided "as is" and "as available" without warranties of any kind, either express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not guarantee that our Services will be uninterrupted, error-free, or secure.

12. LIMITATION OF LIABILITY

To the maximum extent permitted by law, Tiipi LLC and its officers, members, employees, and affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of our Services or products. Our total liability for any claim related to these Terms or our Services shall not exceed the amount you paid us in the twelve months preceding the claim.

13. INDEMNIFICATION

You agree to indemnify and hold harmless Tiipi LLC and its officers, members, employees, and affiliates from any claims, damages, losses, liabilities, and expenses arising from your use of our Services, your violation of these Terms, or your violation of the rights of any third party.

14. GOVERNING LAW AND JURISDICTION

These Terms are governed by the laws of the State of Oregon, without regard to its conflict of law principles. Any dispute arising from these Terms or our Services shall be resolved in the state or federal courts located in Josephine County, Oregon, and you consent to the personal jurisdiction of those courts.

15. CHANGES TO THESE TERMS

We may update these Terms from time to time. We will post the updated Terms on this page and update the "Last Updated" date above. Continued use of our Services after changes constitutes acceptance of the updated Terms.
